Terms of Use for Patients

Welcome. These Terms of Use are an agreement between you and MaxGen Labs ("we", "us") about your use of the patient portal at https://portal.maxgenlabs.com. The portal lets you see the laboratory results and reports for your genetic test, learn about them, and manage the kits on your account. Please read these terms; by signing in and accepting below you agree to them.

1. Who can use this portal

You must be at least 18 years old to hold an account. If you are viewing results for someone else, such as your child or a person you are legally authorized to act for, you confirm that you have that authority, and you are responsible for what you do with their information. When a child on your account turns 18, the results become theirs to control; we may ask them to accept these terms and ask you to stop viewing them.

2. What the portal is for

Your laboratory results. The official result of your test is the laboratory report released by MaxGen Labs. You can view and download it here. Your results are also available to the practice that ordered your test.

Learning, not diagnosing. The Symptom Explorer, Gene Explorer and printed summaries are provided for educational purposes only. They help you learn what your results mean and give you and your practitioner things to talk about. They do not know your medical history, your medicines or your other lab results, and they cannot tell you what is wrong with you or what to do about it.

Not medical advice. Nothing on this portal is medical advice, a diagnosis, a treatment plan or a prescription. Do not start, stop or change a supplement, a food, or a medicine because of what you read here. Your practitioner decides what, if anything, to change, and talks it through with you. If you feel unwell, contact a healthcare provider. In an emergency, call your local emergency number.

Genes are one input among many. Your test looks at a targeted set of selected genetic variants, not your whole genome. A gene result is not the same as the condition or trait it is associated with; many people with a variant never notice it, and many symptoms have nothing to do with genes. The interpretations come from published research and from inference, and they change as the science and our reference data are updated. Not a medical device. The explorers and summaries are not cleared or approved by the U.S. Food and Drug Administration and are not intended to diagnose, treat, cure or prevent disease.

3. Your account

You sign in with a Microsoft-backed account tied to your email address. That address is the key to your results: only it can see them. Keep your password and two-step verification private, sign out on shared devices, and tell us at help@maxgenlabs.com if you think someone else has used your account or if your email address changes. You are responsible for activity under your account until you tell us it has been compromised.

4. Family profiles and other people's results

Kits for family members can be linked to one account. Only link a kit for a person you are entitled to act for. Each person's results are their own; we record who viewed what, and we may ask for a parent or guardian's confirmation before a minor's results open. Do not share another person's results beyond what they, or the law, allow.

5. Your information and privacy

Our Privacy Notice explains what we collect, how we use it, who can see it and how long we keep it. Our Notice of Privacy Practices explains your rights under HIPAA. Both are linked from every page. In short: your results are visible to you, to the practice that ordered your test, to MaxGen Labs staff who support your account, and in the access record we keep for security and compliance; we never sell your genetic information; and every view of your results is logged.

6. Sharing with a practitioner

You may choose to share your reports with a practitioner or practice. Sharing is always your choice, never a condition of testing, and you can revoke it in Settings. Once a practice has your reports, what it does with them is governed by its own duties, not by these terms.

7. Deleting your data

You can ask us to delete your genetic data, reports and account from Settings. There is a thirty-day grace period during which you can cancel; after it, deletion is permanent and cannot be undone. We keep only a minimal record that a deletion occurred and the record of the agreements you accepted; neither holds genetic data. Where the law that governs clinical laboratories requires us to keep a laboratory record for a set time, we keep only what it requires, for only that time.

8. Consent to electronic communications

What you are agreeing to. We communicate with you electronically: by email to the address on your account and through the portal. That includes notices about your samples and results, sign-in invitations, verification codes, security notices, these terms and our notices, and changes to any of them. Your acceptance of documents in this portal by sliding or clicking is your electronic signature, and it has the same effect as a signature on paper.

What you need. A device with a current web browser, an email account you can access, and a connection to the internet. To keep a copy of a document, use your browser's print or save function; you can also read the current versions at any time from the links on every page.

Paper copies. You may ask for a paper copy of any notice or of the documents you accepted by writing to help@maxgenlabs.com. We may charge a reasonable fee for paper copies where the law allows.

Withdrawing your consent. You may withdraw this consent at any time by writing to help@maxgenlabs.com. Because the portal only works electronically, withdrawing means closing your portal account; you can still ask the practice that ordered your test for your report, and you can still ask us for a paper copy.

Keep your address current. Tell us if your email address changes. A notice sent to the address on your account counts as delivered to you.

9. Using the portal responsibly

You will use the portal only for yourself and the people you are entitled to act for. You will not try to reach anyone else's results, share your login, copy or scrape the reference content, interfere with the portal, or use it for anything unlawful. We may suspend or close an account that breaks these rules or endangers other people's information.

10. Our content

The portal, its software, the reference content and the MaxGen Labs name belong to us or our licensors and are for your personal use. Your laboratory reports are yours to keep, share with your practitioners, and use for your own care.

11. Disclaimers and limits on our responsibility

We work to keep the portal accurate, available and secure, but the educational content is provided "as is" and we do not promise it is complete, error-free or right for your situation. To the fullest extent the law allows, we are not responsible for indirect or consequential losses arising from the portal, and our total responsibility to you for claims about the portal is limited to the amount you paid us for the test in the twelve months before the claim. Nothing in these terms limits any right or protection you have under the law that cannot be limited, including your rights regarding the laboratory testing itself.

12. Changes to these terms

When we change these terms in a way that matters, we will ask you to accept the new version the next time you sign in; the version date appears at the top. If you do not agree, do not continue to use the portal; you can write to us to close your account or to request your report.

13. Governing law

These terms are governed by the laws of the state in which MaxGen Labs is organized, without regard to its conflict-of-law rules, except where the law where you live gives you protections that cannot be taken away.
